Kinetic Latitude ("we", "us", or "our") operates the Kinetic Latitude mobile and web application (the "Service"). We are committed to protecting your privacy no matter where in the world you access the Service. This Privacy Policy explains what personal information we collect, how we use it, and the rights you have under applicable global privacy laws — including the EU/UK General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), Brazil's Lei Geral de Proteção de Dados (LGPD), and other regional data protection frameworks.

1. Information We Collect

We collect the following categories of information:

  • Account information: email address and authentication credentials when you register or sign in.
  • Profile content: display name, photos, captions, comments, and likes you submit to the community feed.
  • Saved itineraries: destinations you add to your personal atlas.
  • Usage data: aggregated analytics about how you interact with the Service (e.g., pages viewed, features used).
  • Device and location data: approximate location used to display nearby content, and standard device identifiers, only when you grant permission.

2. How We Use Your Information

  • To provide, operate, and maintain the Service.
  • To create and manage your account and display your contributed content.
  • To show personalized destination recommendations and itineraries.
  • To analyze usage trends and improve our content and features.
  • To detect, prevent, and address fraud or misuse of the Service.
  • To respond to your requests, comments, and support inquiries.

3. Legal Basis for Processing (GDPR/UK GDPR)

For users in the European Economic Area, the United Kingdom, and Switzerland, we process personal data based on: your consent; the performance of a contract (providing the Service you requested); compliance with legal obligations; and our legitimate interests in operating and securing the Service. You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.

4. Sharing and Disclosure

We do not sell your personal information. We may share data with:

  • Service providers who help operate the Service (hosting, analytics, email delivery) under confidentiality obligations.
  • Affiliate booking networks, only when you choose to view a hotel booking link (your interaction with those sites is governed by their own policies).
  • Authorities where required by law or to protect our rights and safety.

5. International Data Transfers

The Service is global and your information may be processed in countries other than your own. We use appropriate safeguards such as Standard Contractual Clauses (SCCs) and equivalent transfer mechanisms to ensure your data is protected consistent with this Policy and applicable law.

6. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. You may request deletion of your account and associated data at any time; we will remove it within a reasonable period, subject to legal retention requirements.

7. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Access or receive a copy of your personal data.
  • Correct inaccurate or incomplete data.
  • Delete your personal data (the "right to be forgotten").
  • Restrict or object to processing.
  • Withdraw consent at any time.
  • Port your data to another service.
  • Opt out of the "sale" or "sharing" of personal information (CCPA/CPRA).

To exercise any of these rights, contact us at thekineticlatitude@gmail.com. We will respond within the timeframe required by applicable law (generally within 30 days).

8. Children's Privacy

The Service is not directed to children under 16 (or the minimum age in your jurisdiction). We do not knowingly collect personal data from children. If you believe a child has provided us information, contact us and we will delete it promptly.

9. Security

We use reasonable technical and organizational measures to protect your data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Cookies and Tracking

We use minimal cookies and local storage for authentication and to remember your preferences (such as motion settings). We do not use cookies for cross-site advertising tracking.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the Service and updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
